  • Can I register my copyright?

    Copyright can be registered. However, registration is not required in order for copyright to subsist in a work. A registered copyright may be useful in proving infringement.

  • What is the relevance of non-disclosure agreements to intellectual property transactions?

    Intellectual property transactions range from initiatives carried out during the early pre-launch stages of a product up to your exit strategy. At each stage of your product's life cycle, it will likely be necessary to keep some information confidential, especially when proprietary knowledge is involved. A non-disclosure agreement sets out the basis on which others access and/or use the proprietary knowledge related to your product or service. The non-disclosure agreement also establishes "disclosure boundaries" by clearly stating what other parties cannot do with your proprietary knowledge.

  • Is there a difference between a sole and an exclusive license?

    Yes. A sole license allows the licensor and the licensee to exploit (commercially and otherwise) the licensed IP. An exclusive license allows only licensee to exploit the licensed IP.

  • Are all marks registrable as trademarks?

    No. Certain words and symbols are not trademark registrable. In addition, marks that are confusingly similar to an existing or pending trademark are likely not registrable.
